This article argues that current programmes in the human sciences which adopt a multi-disciplinary approach to history need to be wary of treating the knowledge of the natural sciences as being independent of social influence. Such efforts to do ‘Big History’, ‘Deep History’ or co-evolutionary history themselves have a past, and this article suggests that potential practitioners could benefit from considering that historical context. To that end, it explores the career of Herbert John Fleure, a scholar whose (...) career defied disciplinary classification, but who was concerned to understand how the human past and present could be understood as they combined in the physical and social context of their production, and what they implied for the possibility of a human future. It concludes by arguing that Fleure’s major lesson for modern researchers is his confrontation of the contingent nature and political consequences of his conclusions. (shrink)

My 2019 article ‘From Planning to Prototypes: New Ways of Seeing Like a State’ (P2P) drew attention to some shortcomings of the kinds of critical, reformist impulses fostered in law and development work. I sought to show that persistent preoccupations with the destructive hubris of ‘top-down’ planning—especially state planning—bypassed the tendency for great power to be deployed in other stylistic modes: through the release and responsive tweaking of prototypes, for instance. This article engages with later developments—at one of P2P’s main (...) field sites and scholarly literature in dialogue with P2P—to build upon the analysis therein. It elaborates on the kinds of power animated through prototyping, showing how prototyping is often combined with other governance styles and what it makes of the inputs on which law has typically been said to draw and of law’s claims to autonomy. It complicates the provenance of this style by reference to mid-to-late-twentieth century UN sanctions regimes, highlighting that governance prototyping is as much state-made as business-led and not restricted to the development field. With particular attention to the strangeness of the human user presupposed by prototyping, this article also aims to identify some modes of critical engagement to which this governance style might be answerable. Built environments, and social and legal interactions through them, are powerfully shaped by the arrangements by which their making and remaking are financed. There is a rich literature analysing shifts towards private and/or offshore financing of infrastructure in broad terms and their implications for governmental accountability and so-called public interest values. At the level of mundane regulatory decision and technique, however, the ways in which governance may be affected by such financing arrangements have not been well mapped. The article considers (...) some governance implications of the practice of funding urban infrastructure projects by recourse to global financial markets. It focuses, in particular, upon how regulatory decision-making may be shaped by technical practices of financial deal-making, financial modelling and related re-configurations of institutional or jurisdictional space. These implications are explored by reference to some recent examples of urban toll-road financing in Sydney, Australia and decision-making and analysis surrounding those examples. As such, it joins with other recent scholarship in probing political dimensions of technical forms of knowledge and practice that have frequently fallen between the cracks of legal scholarship's interdisciplinary inquiries to date. Humanitarian maps assembled using digital technology are indicative of transformations underway in how the world is made knowable, sensible, and actionable, including for international legal purposes. These transformations are exemplified by the Missing Maps Project (MMP), an initiative of the Humanitarian OpenStreetMap Team, a U.S.-registered non-profit, and three other non-governmental organisations operating internationally: American Red Cross; British Red Cross; and Médecins Sans Frontières. Projects such as the MMP make it harder for international lawyers to lay claim to, and seek to (...) imaginatively reorient, shared repositories of common sense. Meanwhile, international legal scholars continue to propagate ideas that the world may be reimagined with their help, largely without regard to such transformations. In lieu of imagination’s standard evocation to the end of enhancing critical agency in international legal writing, this article contends that the idiosyncratic notion of imagination advanced in the writings of Walter Benjamin may be better attuned to ongoing shifts in sense-making apparent in international humanitarian mapping. Walter Benjamin’s atypical rendering of imagination as a ‘purely receptive, uncreative’ force in a field of technological reproduction offers international legal scholars another way of thinking about agency and prospects for re-forming their field in the face of its burgeoning digitalisation. We describe a set of two computer‐implemented models that solve physics problems in ways characteristic of more and less competent human solvers. The main features accounting for different competences are differences in strategy for selecting physics principles, and differences in the degree of automation in the process of applying a single principle. Dewey’s book is the first systematic attempt at a pragmatistic logic (since the work of Peirce). Because of the ambiguity of the concept of pragmatism, the author rejects the concept in general. But, if one interprets pragmatism correctly, then this book is ‘through and through Pragmatistic’. What he understands as ‘correct’ will become clear in the following account. The book takes its subject matter far beyond the traditional works on logic. Such a civic environmentalism argues that it is not enough to strive to preserve enclaved 'wilderness' or 'biodiversity' (as important as that is). It argues also for fundamental changes in the political and economic status quo, because ecological havoc is understood to be integrally linked with the structural forces that are increasing inequality and weakening democratic publics. Strengthening of the civic commons is integral to protection of the environmental commons. If the environmental commons are the substantive goods in common which are the sustaining grounds of life, the civic commons are the institutions, collective memories, social networks, and skills that enable and inspire individuals to engage with each other in stewarding the common good. Such collective labor for the larger good requires some form of collective imagination which enables awareness of self and other (human or non-human) as inherently valuable. But beyond this, it requires perceptual and social infrastructures that nurture the ability to see self and other as emergent from and dependent on the supra-individual matrix that supports both life and individual. Central to such civic labor, is a non-dualistic understanding of individual/matrix. Such a non-dualistic understanding of self/other-in-matrix is central to political and ecological imaginations that are decentered from ethnic, species, class, gender, or other forms of domination and solipsism.John Dewey's work as a whole is a powerful call for such a non-dualistic understanding of individual-in-matrix, and few have better understood its connections to democracy. But, it is in his philosophy of art that Dewey describes most specifically the central importance of the aesthetic dimension of public culture to overcoming crippling dualisms of Western modernity that vitiate participatory engagement- individual/world, nature/culture, ends/means, leisure/work, art/science, aesthetic/ordinary. His writings on art have not been much utilized in the philosophical work for civic environmentalism. This paper argues for their relevance to its key goal of overcoming the segmentation of life ushered in by modernity and buttressed by these dualisms.We first give an overview of recent theories of civic environmentalism and the crises it engages of inequality, injustice, technocracy, corporatization, and the pervasive assault on place and thinning of public participation. Second, we look at the implications of Dewey'saesthetic ecology for an "environmentalism of daily life" that challenges the false dualisms of neo-liberalism and of technocratic professionalism that undermine place-based [End Page 75] forms of life and knowledge.
